Welcome to Flocci. These Terms of Service ("Terms") govern your use of the entire Flocci ecosystem, a service of Flocci Technologies Private Limited. By accessing any of our Services, you agree to be bound by these Terms and our Privacy Policy.
2. Definitions
- "Service" or "Services": Refers to all Flocci offerings, including our SaaS platforms, Industry Platforms, Marketplaces, D2C applications, physical products, and websites.
- "Content": Refers to all data, text, images, listings, or other materials uploaded, posted, or transmitted by a User.
3. Eligibility and Account
You must be at least 18 years old to use our Services. You are responsible for all activities that occur under your account and for keeping your password confidential.
4. Our Services
Flocci provides a diverse range of technology solutions, including but not limited to:
- Software as a Service (SaaS) Suites for Business: Integrated tools for project management, CRM, HR, and analytics.
- Specialized Industry Platforms: End-to-end solutions for sectors like Education and Hospitality.
- Consumer Marketplaces: Platforms like Flocci Bazaar and Flocci Auctions that connect buyers and sellers.
- Direct-to-Consumer (D2C) Applications and Goods: Mobile apps like Flocci Travels and physical products like Flocci Makhana.
We strive for high availability but do not guarantee uninterrupted service. We reserve the right to modify or discontinue services with appropriate notice.
5. Subscriptions, Fees, and Payments
- Subscriptions: Our SaaS products are billed on a recurring basis. Subscriptions auto-renew unless canceled.
- Marketplace Fees: We may charge transaction fees or commissions on our Marketplace platforms, which will be clearly disclosed.
- Direct Sales: Payment for D2C products and services is due at the time of purchase.
- Payment Processing: Payments are processed through secure third-party gateways. You authorize us to charge your selected payment method.
6. User Conduct and Acceptable Use
In addition to general prohibitions, you specifically agree not to:
- Use the Service to transmit illegal, harmful, or infringing Content.
- Reverse engineer or attempt to extract the source code of our software.
- Misrepresent items, engage in fraudulent bidding, or fail to complete good-faith transactions on our Marketplace platforms.
- Violate any applicable laws or regulations.
7. Intellectual Property
- Our IP: The Services and their original content (excluding User Content) are the exclusive property of Flocci.
- Your Content: You retain ownership of your Content. By posting it, you grant Flocci a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display your Content solely for the purpose of operating, providing, and improving the specific Service you are using.
8. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
9. Termination
You may terminate your account at any time. We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or pose a security risk.
10. Limitation of Liability
To the maximum extent permitted by law, Flocci shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of your use of our digital Services shall not exceed the amount you paid us in the 12 months preceding the claim. For physical goods, our liability is limited to the purchase price of the product.
11. Indemnification
You agree to indemnify and hold harmless Flocci from any claims arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Hazaribagh, Jharkhand, India.
13. Modifications to Terms
We reserve the right to modify these Terms. We will provide at least 30 days' notice for material changes via email or a prominent notice on our platform. Continued use of the Service after changes become effective constitutes acceptance.
